7月17日格林威治时间13时，国际法庭就“贾达夫间谍案”在海牙的和平宫举行公开听证会，院长宣读裁决书。
2016年3月，印度退役海军军官贾达夫在巴基斯坦俾路支省被逮捕，巴方称其涉嫌从事破坏分裂巴基斯坦的活动。
2017年4月，贾达夫被巴基斯坦军事法庭判处死刑，罪名是“间谍、破坏和恐怖主义”。
印度称贾达夫不是间谍，是在巴基斯坦遭绑架，要求巴基斯坦立即释放。2017年5月，印度把贾达夫案告到海牙国际法庭。
首先应该指出，根据联合国有关文件规定，海牙国际法庭没有刑事管辖权，因此无法审判个人，但可以发挥调解和仲裁的作用。巴基斯坦是一个主权独立的国家，完全有权对案件特别是破坏国家安全的案件进行审理并做出最终判决。
其次，长期以来，印度和巴基斯坦的民族和宗教矛盾很深，印度教徒和穆斯林之间的对立情绪非常强烈。任何个案处理不好，就会激化这种矛盾和对抗情绪，进而进一步恶化两国关系。因此，不管是印度还是巴基斯坦，在涉及对方公民的案件处理方面，应该非常谨慎。
第三，媒体常有关于“代理人战争”的报道，而且印度和巴基斯坦不时指责对方支持极端恐怖活动。改善两国关系，需要双方都做出努力，更需要双方拿出诚意和实际行动。实现两国关系的正常化，有利于双方的社会稳定和经济发展，也有利于地区和世界的和平。
我们注意到，巴基斯坦最近接连释放改善与印度关系的善意，特别是7月16日宣布巴领空重新对所有民用航空开放。如果，巴基斯坦以“交换囚犯”方式，将贾达夫交给印方处理，也可能是一个不错的选择。
面对严峻的安全形势和紧迫的发展任务，印度和巴基斯坦双方需要的是真诚和合作。印巴两国和睦相处符合双方根本利益，也是国际社会的共同期盼。
First of all, it should be pointed out that according to the relevant documents of the United Nations, the ICJ has no criminal jurisdiction and therefore cannot try individuals, but it can play the role of mediation and arbitration. As a sovereign and independent country, Pakistan has the full right to try and pass final judgments in criminal cases, especially those that undermine its national security.
Secondly, for a long time, there have been deeply-rooted national and religious disputes between India and Pakistan, and the relationship between Hindus and Muslims has been fraught with difficulties and feelings of hostility. If the case is not properly handled, it will intensify the contradiction and antagonism, and further worsen relations between the two countries. Therefore, both India and Pakistan should be very cautious in dealing with cases involving citizens of the other side.
Thirdly, the media often reports about "proxy war", and now and then, India and Pakistan accuse each other of supporting terrorist activities. To improve bilateral relations, both sides need to make efforts, and more importantly, both sides need to show sincerity and practical actions. Normalization of bilateral relations is conducive to both sides' social stability and economic development, as well as regional and world peace.
It must be noted that recently Pakistan has been showing goodwill for improved relations with India, particularly it announced on July 16 that Pakistan's airspace would be reopened to all civil aviation. If the Pakistani side hands over Kulbhushan Jadhav to the Indian side in the form of "prisoner exchange", it might be considered a prudent decision.
Facing the severe security situation and urgent development tasks, both India and Pakistan need sincerity and cooperation. The harmonious coexistence of India and Pakistan is in the fundamental interests of both sides and it is the common expectation of the international community.
